Unemployment 101

Man holding lay-off notification

There are more than 8 million people without jobs in the United States. Many of them qualify for unemployment, but don’t know what it is and how to get it.

What is unemployment?
Unemployment is also called unemployment insurance. It is a program paid for by employers and your tax dollars when you’re working. If you lose your job and it’s not your fault, you could qualify. These benefits only last for a short time.

How much unemployment can you get and for how long?
The amount of benefits you get depends on how much money you made in the year before you lost your job. When you’re approved, you’ll get a check once a week while you’re looking for work.

Allison F,

I recommend going there in person if you can. Furthermore, most people call around their lunch time or afternoon before it closes. I recommend finding out when it opens and try calling in the first few minutes that it opens.

Dogbowl,

I am not sure what industry requires you to work 65-80 hours a week, but if you resign, you will not receive unemployment.

-Wayne

»

Leseanda,

Write them an email or visit them in person.

-Wayne

»

Padma,

Please check with your local state or city department of unemployment.

Hello Shellster13,

Please check out http://www.nccp.org/profiles/SC_profile_37.html for more information.

»

Frederico,

I am positive that you cannot. However, local and state laws may have a statue on starting your own business. Please check with them.

-Wayne

»

Jordan,

If you are still employed-you cannot receive unemployment benefits. If you are going to be laid off soon, start preparing your unemployment forms that can be found on your local /city unemployment office's website. Furthermore, you sound like a hard working young man and have a talent for being social. Utilize these skills that you have already and put them into your next job search and job. Good luck Jordan.

-Wayne

»

Hey Brooks,

I am not sure of where you are from(CITY/STATE), but I advise you to use GOOGLE.COM and type in your city, county, or state as well as workers compensation or unemployment office to find out more details on your unemployment. Furthermore, depending on your contract and the time that you have been employed by your employer-you should review it.

»

Hey James E23,

You should contact the social security office to find out further steps on a new SSN. Please visit, http://www.ssa.gov/

Identity theft is incredibly prevalent these days and please check with your credit bureau and review all purchases that you have made (check or credit cards).

Hey..

So I don't know if anyone can help me but I'd appreciate it if anyone could give me advice as to what to do for filing for unemployment under my circumstance. The thing is I have been working at a rustic log furniture store as an office manager for the past 8 months and just until recently, (about 3 months ago) my employer has had a hard time paying me on time and for as much as I'm supposed to be compensated for. He is behind on my hours a month and a half, and also 3 months behind on my percentage for commission of sales which typically adds $60-$100 per check which I get issued to me every two weeks. He always pays me at least a day or two late, and when I do try depositing it I get a $7 paper return fee for HIS insufficient funds. Sometimes I try going to his bank to cash it but again, he lacks the funds for me to get paid until usually a week or week and a half later than I was supposed to have been paid. The business isn't doing too good, and many people have been laid off already. The only reason I haven't is because my employer needs me there to keep the business going, for now. I'm sure I'll be laid off in a matter of time but would rather just be laid off now. I'm sure I could talk to him about it but if he can't afford to pay me isn't that a legitimate reason to file for unemployment? I'm worried about not being compensated for my work, and I cannot handle the stress of it all anymore. He's in debt to way too many people, we have horrible relations with resellers, vendors, shippers, and customers. My job is to be the office manager/receptionist, so I have to order supplies.. make up work orders and invoices.. do web work on the website.. and a LITTLE customer service. Since our business is falling behind so bad I can't get all my work done in a day and he puts me in the middle of him and the EXTREMELY ANGRY CUSTOMERS, VENDORS, SHIPPERS, RESELLERS, ETC. I feel like I am being taken for granted. I'm hoping that someone might be able to be willing to read this huge thing [lol] and provide some helpful advice. I'm not very familiar with this stuff. I just turned 19 actually so I really don't know what to do about the situation.

Please help!!

Thanks! :]

I live in California and was put on medical disability for longer than the 12 months protected by FEMLA so my company terminated me on the grounds of "not returning to work from disability leave in 12 weeks." Is this considered "not by my own fault?" I've worked full-time for 7 years for this company and believe I qualify otherwise. I know I cannot file until I am no longer disabled, but want to file ASAP when my disability is over. Thanks!

dtrch-
your first step should be to file for unemployment. You can find more information at the NYS Department of Labor. This is their website...http://www.labor.state.ny.us/unemploymentassistance.shtm.

tthompson,
congratulations to your husband for finally winning his unemployment claim. if your husband feels uneasy about taking his job back, he should work towards finding employment at another company. but, before he does that, he should check with his unemployment case worker to be sure that he won't loose the benefits by turning down a job.

Jobs Producer

»

Dogbowl,
You will not be able to get unemployment if you resign. Youc an only qualify for unemployment if you get fire and it was no fault of your own.

Hi kvandewa,
Your stituation is very complicated and i'm not sure that I fully understand it. It sounds like you need to seek the advice of an unemployment attorney OR you can visit you local unemployment office and see exactly what the qualifications are in your are. In addition, there may be other servcies that your husband can qualify for. You should contact your social services department and get more information on the services they provide.

Hey Phillip,
Unemployment is difficult. Your first step should be to contact your local unemployment agency and talk to someone about your situation. They will tell you how to qualify and give you paperwork to fill-out. This will get the process started. Good luck!

I was recently laid off in CA, applied for benefits on 1/5/2009 and have received zero response from EDD. I have been calling the 800 number nonstop only to get this message: “We are receiving more calls than we can answer” and then, after suggesting other ways to contact EDD, it says good-bye and hangs up. Everyone else that I worked with who got laid off already received their award letters. Any suggestions on how to get through? I am running out of money and food.

My husband was fired from his job back in August of 2008. He finally won his unemployment claim. Just this morning, his old boss called and asked him to come back to work under the same stipulations that he was fired for. My husband is worried that if he dosnt take the offer, he will lose his benifits. He thinks he's being setup to be fired again under the probationary period so they dont have to pay. What to do? I live in FL

I am currently salary employee, and my employrer has told me i must work 65-80 hours a week. If i resign am able to file for unemployment?

Can someone please give me some advice? My husband is in sales and learned in mid-November that his employer needed to move to a 100% commission structure. They were a victim of the credit crisis but were trying to stay afloat. Along with 100% commission, they moved to monthly payments instead of bi-weekly. To help their salespeople increase their take home pay they offered to change their status to laid off so they could supplement their income with unemployment. We didn't do that as we were told it was illegal (by a lawyer). In mid-December we received a check for his commission for November - $1000 less than the base + car and expenses he had been receiving. Today we learned that his check for December will be $1000 less than that ($800 less than what he made while on unemployment previously). Here is the first problem, he was hired by this company in mid August after being laid off due to cuts in early July (he did claim unemployment at that time). Does he qualify for unemployment even though there was a break in his employment. If this company did in fact change his status way back in November would that affect his qualifications?

»

hey slowmotion,
there is a good chance that you will qualify for unemployment. unemployment is designed for people that are out of work, or don't make enough at their current job to meet their needs. of course, you won't receive full unemployment benefits. but hey, every bit counts.

hi jannalm,
i'm very sympathetic to your situation. i did a little reserach and couldn't find any information on unemployment for disabled children in pa. you might want to turn to your local non-profit organizations for assistance.

Jobs Producer

»

hi brooks,
not only may you qualify for unemployment, you might have a wrongful termination lawsuit. you should contact your local unemployment office immediately. you should also seek legal counsel to see if what you boss did was legal.

hey bflores,
this is a very frustrating situation. my first thought would be to go to the unemployment office in person, but then you hit me with the bomb that there is no unemployment office in northern Nevada. looks like you're right. no offices in reno. there is a Job Connect office in your area that might be able to help you. they offer many services including layoff assistance. this is their website. http://detr.state.nv.us/es/es_office.htm

hey gail lindley,

Hi elmer ramos,
because of your long, stable work history, you should definately qualify for unemployment. contact you local unemployment office immediately for more information. in the meantime, you might want to start looking for a new job. use the career coach in this section to help you jumpstart that process.

Hello james_e23,

if you think you are a victim of identify theft, you should contact the Federal Trade Commission. This is their website: http://www.ftc.gov/bcp/edu/microsites/idtheft/
They will help you file a claim and will work with you to catch the person that has stolen your social security number.

Hello Unemployed in NJ,
You definately might be able to collect unemployment in NJ if you are only working 4-16 hours per week. Contact your local unemployment agency and see if you quality. If you don't qualify for unemployment there might be other social service programs that you can participate in.

»

Hi DC in Ft Lauderdale,
Instead of calling and emailing your unemployment agency, you should go there in person. It's much easier to take care of business face-to-face. You should visit the office ASAP in order to get your unemployment reinstated. Make sure you take all of your paperwork with you.
